Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the Tonalli Services  website (the “Service”) operated by Tonalli Services  (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Our Service may contain links to third-party websites or services that are not owned or controlled by Tonalli Services.

Tonalli Services has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Tonalli Services  shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

3. Governing Law

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. 

These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

5. Opt-in SMS/Messaging

By opting in to receive SMS messages from Tonalli Services  (“we,” “us,” “our”), you agree to these Terms and Conditions (Terms).

 

SMS Messaging Service

By providing my phone number, I consent to receive SMS text messages from Tonalli Services for appointment reminders, marketing messages, and general two-way communication. Message and Data Rates may apply.

 

Message Frequency

You will get more than one message from us unless you opt-out, and while messaging frequency varies, you will likely receive up to 4 messages per month. Tonalli Services   reserves the right to alter the frequency of messages at any time to increase or decrease the total number of messages. Tonalli Services and carriers are not liable for delays or undelivered messages.

Message and data rates may apply based on your mobile carrier’s terms.

 

Privacy Policy

Your information will be handled in accordance with our Privacy Policy 

 

Cancellation/Opt-Out Instructions

You can opt out of receiving SMS messages at any time by replying STOP to any message we send you. After you opt out of text messaging, you will receive one additional message confirming your request has been processed.

Liability

We are not responsible for any charges, errors, or delays in SMS delivery or undelivered messages caused by your carrier or third-party service providers.

Requesting Your Health Care Records

  • You have the right to request a copy of your mental health records.
  • To request your records, please submit a written request to your treating clinician or to the practice directly. Requests may be made via email, secure client portal, or in writing. Records will be provided in accordance with Texas law and applicable privacy regulations.
